Case description

On December 2011 the case was sent to RA Criminal Court of Appeal and admitted into the proceedings (chief judge- Sergey Chichoyan): The court session on preliminary investigation which was fixed on December 26 is delayed, the new date of the court session has not been set yet.

The case description 

In the military unit of Ara mountain of Defense Army of Nagorno Karabakh a conscript was murdered  on February 6, 2011, he was Gevorg Andranik Kotsinyan, conscript born in 1992(called up for military service on May 12, 2010 from the Vanadzor military registration and enlistment office).

According to the conclusion of forensic expertise the cause of his death is the reflex cardiac arrest, which is a result of close, blunt injury of the chest.

According to the official version sergeant Margar Davtyan, private soldiers Taron Suvaryan and Vahe Aghajanyan under the influence of alcohol started arguing with Kotsinyan about smoking in the military barrack, using dialect while speaking and doing this or that gestures. They battered Kotsinyan near the cantonment intentionally causing grave bodily harm, which negligently caused the death of the latter.

On February 8 a criminal case was launched on the incident.

Private soldiers Taron Suvaryan and Vahe Aghajanyan were accused of the crime under Article 359, part 2, point 2 of RA Criminal Code (Breach of relations, prescribed by field manuals, between not subordinated servicemen.) and article 112, part 2, points 6, 9, 14 (Infliction of willful heavy damage to health, made by a group of people negligently causing the death of the Injured).

Sergeant Margar Davtyan was charged based on Article 38, Article 359.2.2, 6,9,14 points of part 2 of Article 112 and Article 375.1(Abuse of power) of RA Criminal Code.

Armen Rafayelyan was also charged for abuse of power (Article 375.1 of the Criminal Code) as being a commander he didn't prevent the alcohol use by the three servicemen and others as a result of which Kotsinyan died.

Detention was chosen as a preventive measure against all the accused.  The successor of the victim is Boris Adamyan, Gevorg Kotsinyan's uncle. The case was sent to the court on June 16, 2011.

On November 14, 2011 the court of of general jurisdiction Syunik marz (the residence Stepanakert, chief judge Lernik Atanyan) announced the verdict according to which the 4 defendants were accused on the above mentioned articles.

According to the verdict of the court junior sergeant Margar Davtyan was sentenced to 11 years 6 months imprisonment, the soldiers Taron Suvaryan and Vahe Aghajanyan to 11 years, and senior lieutenant Armen Rafayelyan to 3 years. The 1 subpoint of point 1 of the amnesty passed by RA National Assembly on May, 2011 was applied towards Armen Rafayelyan and he was exempted from punishment.

In December, 2011 the case was sent to RA Criminal Court of Appeal and the proceedings were admitted (Chief judge Sergey Chichoyan). On December 26 the preliminary set court session was delayed. 

The Injured's successor claims to recognize the fact of violation of Kotsinyan's right to life and to demands AMD 5 million compensation in moral damages from the government, and AMD 1,5 million from the defendants in favor of the victim's successor as a funeral compensation and 450 thousand AMD as a compensation for court expenses.

    On March 29 the RA Court of Appeal (chief judge Sergey Chichoyan) rejected all the appeals on case of Gevorg Kotsinyan who died of being battered by his four co-servicemen. The court upheld the decision made by the Court of General Jurisdiction of Syunik marz by which junior sergeant Margar Davtyan was sentenced to 11 years and 6 months imprisonment, soldiers Taron Suvaryan and Vahe Aghajanyan for 11 years imprisonment and senior lieutenant Arman Rafayelyan for 3 years imprisonment. Amnesty was applied to A. Rafayelyan and he was released from punishment.

    On March 15 the appeals were pronounced in the RA Criminal Court of Appeal (chief judge Sergey Chichoyan) on case of serviceman Gevorg Kotsinyan who died of being battered by four co-servicemen.
